Tompkins Wake recently won an application in the Auckland High Court for an urgent interlocutory injunction on behalf of Open Country Cheese Company Limited against Fonterra. Fonterra had refused to supply milk to Open Country for the month of March 2008 at the regulated default milk price. Counsel James MacGillivray says as a result of the successful High Court application, Open Country obtained milk at the default price pending resolution of the substantive issue. A good commercial result.
